In a notice dated Sept. 14, the Delaware Department of Natural Resources and Environmental Control (DNREC) announced that, on Sept. 4, the Secretary John Hughes had issued Secretary’s Order No. 2008-A-0037 to Indian River Power LLC (IRPL). The order requires issuance of a permit to IRPL to regulate construction and operation of a new phase of the industrial landfill located at 29416 Power Plant Road, Millsboro.
IRPL had applied for a solid waste facility permit seeking to construct and operate the Phase II landfill on a site adjacent to the existing Phase I landfill for the continued disposal of coal fly ash and bottom ash generated primarily on-site.
Public hearings on the issue generated significant negative comment from citizens who were concerned about the environmental impact of the new ash landfill, which sits adjacent to an existing bayside landfill location that has been the subject of mandated cleanup. Some citizens have even recommended the state classify coal ash as a hazardous waste.
According to the Sept. 4 order, DNREC will approve the IRPL’s application and issue a permit that will implement construction and operation requirements of the Delaware Regulations Governing Solid Waste, including monitoring, reporting and a capping system. The Secretary’s order is available for review on the Department’s Web site at http://www.dnrec.delaware.gov/Info/Pages/SecOrders.aspx.
Pursuant to 7 Del. C., Section 6008(a), any person whose interest is substantially affected by any action of the Secretary may appeal to the Environmental Appeals Board within 20 days after receipt of the Secretary’s decision or publication of the decision.
