At the Sussex County Sheriff's Office, West Complex, 22215 DuPont Boulevard, Georgetown, Delaware, Georgetown Hundred, Sussex County, State of Delaware, the following described real estate to wit:

ALL THAT certain lot, piece or parcel of land lying and being in Dagsboro Hundred Sussex County and State of Delaware being known and designated as Lot 4 block B of Sandy beach as more particularly bounded and described in accordance with a survey prepared by Simpler Surveying and Associates, dated July 16, 2002, as follows, to-wit:

BEGINNING at a pipe situate on the westerly right of way of Sandy Beach Drive said pipe being 405 feet northerly of the right of way of County Route 333 being a corner for these lands and lot 3 thence by and with lot 3 North 78 degrees 5 minutes 35 seconds West 103.00 feet to a pipe said pipe being a corner for these lands Lot 3 and a point for lot 25 thence by and with lot 25 North 11 degrees 54 minutes 25 seconds East 130.00 feet to a rebar being a corner for these lands and lot 5 and a point on line for lot 24 thence by and with Lot 5 South 78 degrees 5 minutes 35 seconds East 103 feet to a rebar said rebar being a corner for these lands and lot 5 thence by and with said Sandy Beach drive South 11 degrees 54 minutes 25 seconds West 130.00 feet to the point and place of beginning.

AND BEING the same lands and premises conveyed unto Robert A. Muth and Maria A. Muth, by deed of Dennis R. Taylor and Cheryl A. Taylor dated February 7, 2003 and of record in the Office of the Recorder of Deeds in and for SUSSEX County and State of Delaware in deed Book 2801 Page 330.

Registration is required for all bidders prior to sale. A $4,000.00 deposit (Cash or Cashiers/certified check payable to Sheriff of Sussex County) and valid driver’s license or photo I.D. are required to register.

TERMS: 20 percent of the purchase money will be demanded on day of sale (The $4,000.00 Bidder Registration Fee will be credited to the 20% deposit). Cash, Certified Check or Cashier's Check, is required. The balance is to be paid on or before July 7, 2008. Sale subject to confirmation by the Superior Court on July 11, 2008 and also subject to a 1 1/2 percent Delaware Realty Transfer Tax; 3/4 percent to be paid by the Seller and 3/4 percent to be paid by the Purchaser. Also subject to 1 1/2 percent Sussex County Realty Tax, 3/4 percent to be paid by the Seller and 3/4 percent to be paid by the Purchaser. Any further Transfer Tax is the responsibility of the Purchaser. The Purchaser will be required to pay the cost of the deed; a $200.00 deposit will be collected at the time of sale and will be refunded if a proper deed is presented to the Sheriff’s Office within Forty-Five days of confirmation.
