will be exposed to Public sale on:
Tuesday, September 16, 2008 At 9:30 A.M. & Thereafter

At the Sussex County Sheriff's Office, West Complex, 22215 DuPont Boulevard, Georgetown, Delaware, Georgetown Hundred, Sussex County, State of Delaware, the following described real estate to wit:

All that certain lot, piece or parcel of land lying and being in the Town of Millsboro, Dagsboro Hundred, County of Sussex, State of Delaware, and lying on the North side of the continuation of Church Street, which said continuation is widened from 20 feet, which is said street as now is to 28 feet wide, four feet on each side of said street corner for Lot of Hurley B. Mitchell one of these Grantees said described Lots being Lots No. 4 & 5 , lying on the North side of aforesaid Church Street and East side of a Street leading form the four corners to Ben's Mill Pond; thence beginning at the corner of Church Street and East corner of aforesaid street leading from four corners to Betts's Mill Pond, and being Lot No. 5; thence North 27 1/4 degrees East 120 feet to a stake on the East side of aforesaid street and corner for land of Jacob P. King; thence with land of said King with Lots No. S & 4, South 62 degrees 10 minutes East 110 feet to a stake corner for Lots 3 & 4; thence with line of Lots 3 & 4; thence with line of Lots 3 & 4 South 27 1/4 degrees West 120 feet to a stake driven on North side of Church Street right of way and corner for Lots No. 4 & S, 110 feet to beginning.

Being the same lands and premises which Gary Lee Mitchell, Trustee under a Revocable Trust Agreement dated September 2, 1992, did grant and convey unto Gerald L. Johnson, Jr. and Gina M. Johnson by deed dated 12/6/2004 and recorded 12/16/2004 Office of the Recorder of Deeds, in and for Sussex County, State of Delaware, in Deed Record BK03075PG006.

Registration is required for all bidders prior to sale. A $4,000.00 deposit (Cash or Cashiers/certified check payable to Sheriff of Sussex County) and valid driver’s license or photo I.D. are required to register.

TERMS: 20 percent of the purchase money will be demanded on day of sale (The $4,000.00 Bidder Registration Fee will be credited to the 20% deposit). Cash, Certified Check or Cashier's Check, is required. The balance is to be paid on or before October 6, 2008. Sale subject to confirmation by the Superior Court on October 10, 2008 and also subject to a 1 1/2 percent Delaware Realty Transfer Tax; 3/4 percent to be paid by the Seller and 3/4 percent to be paid by the Purchaser. Also subject to 1 1/2 percent Sussex County Realty Tax, 3/4 percent to be paid by the Seller and 3/4 percent to be paid by the Purchaser. Any further Transfer Tax is the responsibility of the Purchaser.
