TOWN OF BETHANY BEACH - PUBLIC NOTICE - VOTER REGISTRATION

The Annual Election for the Town of Bethany Beach Town Council shall be held in the Bethany Beach Town Meeting Room, 214 Garfield Parkway, Bethany Beach, DE, on Saturday, September 11, 2010, from 12:00 Noon to 6:00 p.m. prevailing time.

Bethany Beach property owners who are listed on the Town’s Property Tax List ARE NOT REQUIRED to register to vote in town elections.

Residents of Bethany Beach (who do not own property) must register to vote at least 30 days prior to the election. Residents may register at Town Hall or request a mailed registration form by telephone, mail or by email. (Contact information is below.)

The last day to register for this year’s election is August 11, 2010.

DELAWARE CAPITAL TRANSPORTATION PROGRAM PUBLIC HEARINGS

Interested persons are encouraged to participate in the development of the state’s future transportation program by attending public hearings to be held in late summer. The hearings are jointly sponsored by the Council on Transportation, the Dover Kent Metropolitan Planning Organization (MPO), the Wilmington Area Planning Council (WILMAPCO), Sussex County, and the Delaware Department of Transportation (DelDOT).

The hearings provide an opportunity to review current and suggested transportation projects. Also, the public will have a chance to view the reductions to the DelDOT work program as a result of decreased revenues coming into the Transportation Trust Fund. Hearings are being held as follows:

• In New Castle County at the WILMAPCO offices, 850 Library Ave.,
Newark, on Monday, August 30, 2010, from 4 p.m. to 7 p.m.

• In Kent County at the DelDOT Administration Building, 800 Bay
Road, Dover on Wednesday, September 15, 2010, from 4 p.m. to 7 p.m.

• In Sussex County at the South District Administration Building,
23697 DuPont Boulevard, Georgetown on Thursday, September
16, 2010, from 4 p.m. to 7 p.m.

Interested persons are also encouraged to submit written comments during the public hearing process.

The MPO’s are composed of representatives from state, county and local governments, and citizen and technical representatives. Mandated by 29 Delaware Code, §8409, the hearings are designed to ensure that the public has ample opportunity to participate in the planning process. The Council on Transportation is composed of citizen representatives from every county in the state. Members are appointed by the Governor.

These meeting locations are accessible to persons having disabilities. Any person having special needs or requiring special aid, such as an interpreter for the hearing impaired, is requested to contact DelDOT by phone or mail one week in advance of the planned event. TOWN OF MILLVILLE - PUBLIC NOTICE

The Town Council of the Town of Millville will hold a Public Hearing on Tuesday, July 14, 2009, at 7:00 p.m., located at the Town Hall, 11 Club House Road, to read for possible adoption, draft Ordinance 10-02 entitled “Street Naming and Addressing.” If adopted, the Sussex County Government will assign 911 property numbers to all dwellings, principal buildings and businesses, in order to assist emergency service agencies, the United States Postal Service and the public in the timely and efficient provision of services to residents, property owners and businesses of the Town of Millville. The draft ordinance can be reviewed at the Town Hall during regular business hours, Monday through Friday 9:00 a.m. to 4:00 p.m. If unable to attend the Public Hearing, written comments will be accepted prior to the hearing.

This table shows the results of our monitoring for the period of January 1st to December 31st, 2008. As water travels over the land or underground, it can pick up substances or contaminants such as microbes, inorganic and organic chemicals, and radioactive substances. All drinking water, including bottled drinking water, may be reasonably expected to contain at least small amounts of some constituents. It's important to remember that the presence of these constituents does not necessarily pose a health risk.

In this table you will find many terms and abbreviations you might not be familiar with. To help you better understand these terms we’ve provided the following definitions:

Non-Detects (ND) - laboratory analysis indicates that the constituent is not present.
Parts per million (ppm) or Milligrams per liter (mg/l) - one part per million corresponds to one minute in two years or a single penny in $10,000 or 1 drop in 13 gallons.
Parts per billion (ppb) or Micrograms per liter - one part per billion corresponds to one minute in 2,000 years, or a single penny in $10,000,000. Or 1 drop in 13,000 gallons.
Action level - the concentration of a contaminant which if exceeded, triggers treatment or other requirements which a water system must follow.
Treatment Technique (TT) - A treatment technique is a required process intended to reduce the level of a contaminant in drinking water.
Maximum Contaminant Level (MCL) - The “Maximum Allowed” (MCL) is the highest level of a contaminant that is allowed in drinking water. MCLs are set as close to the MCLGs as feasible using the best available treatment technology.
Maximum Contaminant Level Goal (MCLG) - The “Goal” (MCLG) is the level of a contaminant in drinking water below which there is no known or expected risk to health. MCLGs allow for a margin of safety.
Maximum Residual Disinfectant Level (MRDL) - The highest level of a disinfectant allowed in drinking water. There is convincing evidence that addition of a disinfectant is necessary for control of microbial contaminants.
Maximum Residual Disinfectant Level Goal (MRDLG) - The level of a drinking water disinfectant below which there is no known or expected risk to health. MRDLGs do not reflect the benefits of the use of disinfectants to control microbial contaminants.

All other contaminants were ND in compliance with the Safe Drinking Water Act.

The table shows that our system uncovered some problems this year. The duration of the violation was from 12/18/07 until 12/31/08. The potential adverse health effects are: Some people who drink water containing trihalomethanes in excess of the MCL over many years may experience problems with their liver, kidneys, or central nervous systems, and may have an increased risk of getting cancer. We are correcting this by flushing and re-sampling. Furthermore, the water treatment plant has been redesigned and we expect once the new plant is on line it will remove the precursors that result in high TTHM levels.

The sources of drinking water (both tap water and bottled water) include rivers, lakes, streams, ponds, reservoirs, springs, and wells. As water travels over the surface of the land or through the ground, it dissolves naturally occurring minerals and, in some cases, radioactive material, and can pick up substances resulting from the presence of animals or from human activity. In order to insure tap water is safe to drink, EPA prescribes regulations which limit the amount of certain contaminants in water provided by public water systems. Food and Drug Administration regulations established limits for contaminants in bottled water, which must provide the same protection for public health.

All drinking water, including bottled water, may reasonably be expected to contain at least small amounts of some contaminants. The presence of contaminants does not necessarily indicate that the water poses a health risk. More information about contaminants and potential health effects can be obtained by calling the Environmental Protection Agency's Safe Drinking Water Hotline at 1-800-426-4791.

MCL’s are set at very stringent levels. To understand the possible health effects described for many regulated constituents, a person would have to drink 2 liters of water every day at the MCL level for a lifetime to have a one-in-a-million chance of having the described health effect.

In our continuing efforts to maintain a safe and dependable water supply it may be necessary to make improvements in your water system. The costs of these improvements may be reflected in the rate structure. Rate adjustments may be necessary in order to address these improvements.

Some people may be more vulnerable to contaminants in drinking water than the general population. Immuno-compromised persons such as persons with cancer undergoing chemotherapy, persons who have undergone organ transplants, people with HIV/AIDS or other immune system disorders, some elderly, and infants can be particularly at risk from infections. These people should seek advice about drinking water from their health care providers. EPA/CDC guidelines on appropriate means to lessen the risk of infection by cryptosporidium and other microbiological contaminants are available from the Safe Drinking Water Hotline (800-426-4791).

THE WATER TREATMENT PROCESS
To provide you with quality drinking water, reliable treatment methods are used to eliminate or minimize the effects of contaminants that may be present in source waters. Water quality is monitored at each wellfield and throughout the distribution system to determine that state and federal primary water quality standards are met.
Groundwater from wells first passes through layers of soil, sand and gravel, which act as a natural filter. Groundwater comes from an underground source of water known as an aquifer. Those groundwater supplies are disinfected with chlorine to destroy bacteria that may be present and protect against microbial contaminants before being pumped into the distribution system. The level of this additive is monitored daily to ensure the proper dosage is being added. In some cases, pH correction and filtration are utilized.
Samples of treated and untreated water are taken regularly to ensure that the required level of drinking water quality is maintained and that samples comply with state and federal standards for quality and safety.

A Word of Caution
Town of Ocean View’s treatment system is designed and operated to produce water that is in compliance with all state and federal drinking water standards. Many substances and microscopic organisms found in water may be a concern if they occur at high concentrations. For some contaminants, Maximum Contaminant Levels (MCL) have not been set because the EPA has not determined at what level they pose a public health risk. This is often because a reliable detection method is unavailable and/or because the contaminant is rarely found in treated water.
Some naturally occurring organisms commonly found in the natural water supplies may not be eliminated during the treatment process. This means that even a well-run system may contain low levels of microscopic organisms. The levels, however, are normally of little concern to healthy individuals. It should be noted, however, that under certain circumstances, these organisms might amplify to serious levels within a customer’s own water supply system.
All customers, including residential, commercial and industrial customers, and other large facilities such as schools, hospitals and hotels/motels, should follow appropriate procedures for maintaining their own internal plumbing systems and appliances. WHY THERE MAY BE CONTAMINANTS IN THE COUNTRY’S WATER SUPPLY
1Sources of drinking water in the United States (both tap water and bottled water) include rivers, lakes, streams, ponds, reservoirs, springs and wells. As water travels over land or through the ground, it dissolves naturally occurring minerals and organics and can pick up substances resulting from the presence of animal or human activity. Contaminants that may be present in source waters include:

Microbial contaminants, such as viruses and bacteria, which may come from sewage treatment plants, septic systems, livestock and wildlife.

Inorganic contaminants, such as salts and metals, which can be naturally occurring or result from storm water runoff, wastewater discharges, or farming.

Pesticides and herbicides, which may come from a variety of sources such as agriculture, storm water runoff, and residential uses.

Organic contaminants, including natural, synthetic and volatile organic chemicals, which are by-products of nature and industrial processes and petroleum production, and can also come from gas stations, storm water runoff and septic systems.

Radioactive contaminants, which can be naturally occurring.

All drinking water, including bottled water, may reasonably be expected to contain at least small amounts of some contaminants. Fortunately, in Delaware, most of these contaminants are not an issue. The presence of contaminants does not necessarily indicate that water poses a health risk. More information about contaminants and potential health effects can be obtained by calling the EPA’s Safe Drinking Water Hotline at (800)426-4791.

In order to ensure that tap water is safe to drink, the EPA and the State Division of Public Health (DPH) prescribe regulations, which limit the amount of certain contaminants in water provided by public water systems. Food and Drug Administration regulations establish limits for contaminants in bottled water, which must provide the same protection for public health. DPH also provides monitoring schedules and establishes sampling requirements for water utilities in order to maintain compliance with the Safe Drinking Water Act monitoring requirements.

What the Numbers Mean To You: The table shows the results of our monitoring during 2008. The EPA requires monitoring of numerous drinking water contaminants. Those listed are the only contaminants detected. The State requires water systems to monitor for certain contaminants less than once a year because the concentration of these contaminants is not expected to vary significantly from year to year.

NTU: (Nephelometric Turbidity Unit) used to measure cloudiness in drinking water. Std: Standard Units. RUL: Recommended Upper Limit. AL: Action Level. The concentration of a contaminant which, if exceeded, triggers treatment or other requirements which a water system must follow. >: Less than.

For Your Safety - A Message for People with Compromised Immune Systems
Certain individuals may be more vulnerable to contaminants in drinking water than the general population and have special needs regarding water quality. Special Considerations Regarding Children, Pregnant Women, Nursing Mothers, and Others
Children may receive a slightly higher amount of contaminant present in the water than do adults, on a body weight basis, because they may drink a greater amount of water per pound of body weight than do adults. For this reason, reproductive or developmental effects are used for calculating a drinking water standard if these effects occur at lower levels than other health effects of concern. If there is insufficient toxicity information for a chemical (for example, lack of data on reproductive or developmental effects), an extra uncertainty factor may be incorporated into the calculation of the drinking water standard, thus making the standard more stringent, to account for additional uncertainties regarding these effects. In the cases of lead and nitrate, effects on infants and children are the health endpoints upon which the standards are based.

TOWN OF BETHANY BEACH - NOTICE OF TOWN COUNCIL ELECTION - NOTICE OF SOLICITATION FOR CANDIDATES

The Annual Election for the Town of Bethany Beach Town Council shall be held in the Bethany Beach Town Meeting Room, 214 Garfield Parkway, Bethany Beach, Delaware on Saturday, September 12, 2009, from 12:00 o’clock Noon to 6:00 p.m. prevailing time.

Three (3) Town Council Members shall be elected. At least four (4) of the seven (7) members of the Town Council must be residents of the Town, but all may be residents of the Town.

Town Council terms are for a period of two years.

Anyone wishing to file as a candidate for the election must file a written Notice of Intention (Application for Candidacy) in the Town Manager’s Office at Town Hall no later then 4:00 p.m. on Tuesday, July 28, 2009.

Candidates for the Town Council must meet all of the following requirements:
1. Be at least twenty-one (21) years of age;
2. Be a U.S. Citizen;
3. Not have been convicted of a felony;
4. Shall have been, for a period of at least one year prior to the date
of the election; either (a) a permanent full-time resident of the
Town, or (b) a natural person holding record title to a fee simple
or life estate in real property located within the Town of Bethany
Beach;
5. At the time of filing a notice of intention to seek office, be a duly
registered voter under the provisions of the Town Charter (Section
5.2) and Voter Registration Ordinance (Chapter 233 of the Town
Code). Only natural persons are allowed to vote in Town
Elections, and only natural persons who are not identified on the
Town’s tax records as an owner of real estate in the Town are
required to register. Persons may register in person at the Town
Hall or by mail during normal business hours except during the
last 30 days before the election. Contact the Town Hall as
instructed in paragraph 6 below.
6. File a written notice of intention to seek office at least forty-five
days (45) days prior to the date set for the election (i.e. by
Tuesday, July 28, 2009). Contact the Town Hall by email at

Voting and Absentee Ballots

Maximum Residual Disinfectant Level (MRDL) - The highest level of a disinfectant allowed in drinking water. There is convincing evidence that addition of a disinfectant is necessary for control of microbial contaminants.

Maximum Residual Disinfectant Level Goal (MRDLG) - The level of a drinking water disinfectant below which there is no known or expected risk to health. MRDLGs do not reflect the benefits of the use of disinfectants to control microbial contaminants.

* The state allows us to monitor for some contaminates less than once per year because the concentrations of these contaminants do not change frequently. Some of our data, though representative, are more than one year old.

All other contaminants were ND in compliance with the Safe Drinking Water Act.

As you can see by the table, our system had no violations. We’re proud that your drinking water meets or exceeds all Federal and State requirements. We have learned through our monitoring and testing that some constituents have been detected. The EPA has determined that level in your water is below the MCL.

The sources of drinking water (both tap water and bottled water) include rivers, lakes, streams, ponds, reservoirs, springs, and wells. As water travels over the surface of the land or through the ground, it dissolves naturally occurring minerals and, in some cases, radioactive material, and can pick up substances resulting from the presence of animals or from human activity. In order to insure tap water is safe to drink, EPA prescribes regulations which limit the amount of certain contaminants in water provided by public water systems. Food and Drug Administration regulations established limits for contaminants in bottled water, which must provide the same protection for public health.

All drinking water, including bottled water, may reasonably be expected to contain at least small amounts of some contaminants. The presence of contaminants does not necessarily indicate that the water poses a health risk. More information about contaminants and potential health effects can be obtained by calling the Environmental Protection Agency's Safe Drinking Water Hotline at 1-800-426-4791.

MCL’s are set at very stringent levels. To understand the possible health effects described for many regulated constituents, a person would have to drink 2 liters of water every day at the MCL level for a lifetime to have a one-in-a-million chance of having the described health effect.

In our continuing efforts to maintain a safe and dependable water supply it may be necessary to make improvements in your water system. The costs of these improvements may be reflected in the rate structure. Rate adjustments may be necessary in order to address these improvements.

Some people may be more vulnerable to contaminants in drinking water than the general population. Immuno-compromised persons such as persons with cancer undergoing chemotherapy, persons who have undergone organ transplants, people with HIV/AIDS or other immune system disorders, some elderly, and infants can be particularly at risk from infections. These people should seek advice about drinking water from their health care providers. EPA/CDC guidelines on appropriate means to lessen the risk of infection by cryptosporidium and other microbiological contaminants are available from the Safe Drinking Water Hotline (800-426-4791).

This ordinance implements a permitting procedure for all persons and entities desiring to open or excavate in the road beds or rights-of-way of the Town. The ordinance imposes construction standards for projects requiring excavation, restoration standards upon completion of the projects, implements bonding and insurance requirements, and liability and violation provisions for damage to public property and violations of this ordinance. This ordinance became effective upon adoption.

Ordinance to Enact Regulations Governing Use of the Bandstand
This ordinance establishes certain content-neutral “time, place, and manner” restrictions on the use of the Town bandstand and/or plaza for purposes of making any “public address” (any public address, program, display, or demonstration) and also to coordinate its use so that no proposed public address will conflict with any other public address or Town-sponsored program, any person or group desiring to make use of the bandstand and/or plaza. This ordinance became effective upon adoption.
